Elbow Injury Soft tissue injuries refer to muscle, tendon, nerve, and ligament damage. Depending on the extent of the injury, tissue injuries can cause pain, swelling and loss of function, and are usually the result of tears, sprains, and strains on the body. It can be hours or days after an accident that a person realizes soft tissue has been damaged. Even though the injury can be extremely debilitating, it cannot be seen on an x-ray.

The term “soft tissue injury” refers to a family of related types of injuries that include whiplash.  With this type of injury, it can be difficult to gather medical evidence of the extent of your pain. Additionally, your pain might not arise until some time has passed since the accident that caused it, making it tricky to trace your pain to the accident itself.

What Are Soft Tissue Injuries?

There are many different types of soft tissue injuries, including:

  • Hyperextension – damage to ligaments in the elbow when it is pushed back or turned the wrong way.
  • Musculoskeletal – caused by repetitive motion, exertion, and/or  stress on a part of the body
  • Rotator Cuff Injuries – injury involving the shoulder
  • Carpal Tunnel Syndrome – muscle weakness, pain, tingling, and other sensations in the wrist that is caused by nerve compression
  • Brachial Plexus Lesion Injury – nerve damage along the spine, neck and arms

What Should I Do After a Soft Tissue Injury?

I Intend to Seek a Private Settlement. Is There Any Reason for Me to Prepare for a Trial?

Yes. Although most soft tissue injury claims are settled out of court, the best way to secure a generous settlement is to show the defendant that you are prepared to win in court if it comes to that. You might also have to file a lawsuit (and perhaps attend a deposition) to motivate the defendant to settle.

What Are “Pain and Suffering” Damages?

Pain and suffering damages are awarded to compensate you for the physical pain you suffered. As long as you can prove the full extent of your pain and suffering, your pain and suffering damages could far exceed your compensation for medical expenses. Other possible types of intangible damages include:

  • Mental anguish
  • Loss of enjoyment of life
  • Loss of consortium
Can I Enforce a Claim Against the Employer of a Commercial Driver Who Injured Me in a Car Accident?

Yes, as long as the commercial driver was acting within the scope of his duties at the time of the accident, and as long as the driver really was an employee. Commercial truckers, for example, are usually considered independent contractors rather than employees.
