  • What Type of Damages Are Available Under Georgia Personal Injury Law?

    The state allows three different types of damages, depending on the facts of the case:

    • Economic damages:  Medical bills, lost work time and just about any loss you can easily count.
    • Noneconomic damages:  Intangible damages such as mental anguish and loss of enjoyment of life.
    • Punitive damages:  An additional amount awarded to punish the defendant for particularly outrageous conduct (most cases do not qualify for punitive damages, however).
  • I Heard That Georgia Has Placed a Cap on Non-Economic Damages in Medical Malpractice Cases. Is That True?
    No, not anymore. A few years ago, the state capped non-economic damages in medical malpractice cases, but the Georgia Supreme Court declared the law unconstitutional (based on the state constitution).
