Herniated Disc and Back Injury Attorneys Serving Atlanta, Alpharetta and all Georgia

Discs are natural shock absorbers located between the vertebrae of your spine. A herniated disc occurs when the disc is injured, breaks open and the soft interior protrudes through the rupture. Herniated discs are often caused by car accidents, although there are many other potential causes as well.

When a herniated disc irritates a nearby nerve it can result in pain, numbness, and weakness in your arm, leg, or buttocks. In extreme cases, surgery may be required to prevent permanent paralysis or weakness. In many cases, however, a herniated disc causes no symptoms at all until long after the accident that caused it.

Injuries to the spine can be caused by many different types of accidents and activities. A herniated disc, sometime called a “slipped disc” or “ruptured disc” is caused when a sudden or repeated activity pushes the cartilage that acts as a cushion between the vertebrae in your spine out of place or damages it. Whiplash is a common accident in vehicle collisions that stretches the neck and can cause a herniated disc. Such injuries are very painful and can be quite debilitating to the victim.

When Your Accident Was Caused by Someone Else

If the accident that caused your herniated disc resulted from by another person’s misconduct (a drunk driver, for example), you have a legal claim for damages under Georgia personal injury law. Your claim is not necessarily limited to reimbursement of your medical expenses – if your herniated disc causes you significant pain, for example, you are entitled to compensation for your pain as well.

Call in the Professionals

Herniated disc cases can be tricky to win if you are not represented by expert legal counsel. If you are like most people, you want a quick but generous private settlement. The source of these funds, however, is likely going to be an insurance company, and insurance companies are notorious for pulling every trick in the book to avoid paying up.

Our firm has represented clients who have suffered spinal injuries and herniated disc damage to help them get seek the financial settlement they need to get the medical treatment they require. Depending on the severity of your injuries there are number of treatments possible to help a person recover from such an injury. Most doctors will recommend types of exercise and stretching therapy before advising surgery. Other treatment options include prescription medications and epidural steroid injections. Recovery can often be a lengthy process with a greatly limited ability to work. Getting a comprehensive physical diagnosis, often through the help of an MRI, is essential to properly assess the extent of the damage and determine the type and length of your treatment plan.

At Van Sant Law, we have recovered compensation for a multitude of injured victims, including many multi-million dollar resolutions. Some of Our Other Areas of Practice

Following are some of the kinds of cases we commonly take:

Frequently Asked Questions (FAQs)
How Can a Car Accident Cause a Herniated Disc?

The force of impact in a car accident can place great pressure on your spine. The disc’s job is to absorb this shock, and if it absorbs more shock than it was designed to withstand, the disc ruptures, resulting in a herniated disc when the soft insides spill out of the rupture.

What’s the Difference Between a Herniated Disc and a Bulging Disc?

A herniated disc occurs when the disc’s exterior cracks and its soft interior protrudes. A  bulging disc occurs when the disc’s outer surface bulges but does not break. Some doctors do not make a formal distinction between these two conditions.

How Can I Prove the Defendant Is Liable in a Herniated Disc Case?

There are several potential sources of evidence, including:

  • Your own testimony
  • Your doctor’s testimony
  • Your medical records
  • Imaging scans such as X-rays
How Might a Pre-Existing Injury Affect My Claim?

The defendant might claim that your current symptoms were caused by your pre-existing injury rather than by anything that happened to you in the accident. The defendant might also claim that your new injury merely worsened your pre-existing injury and that therefore your compensation demand is too high.
