Dogs are the animals most commonly responsible for attacks. Under Section 4-8-21, dogs may be classified as dangerous or vicious. Certain requirements are imposed on owners of dangerous or vicious dogs. For example, the owner of a dangerous dog needs to keep a locked and secure enclosure to restrain the dog on the owner’s property. There must be a clearly visible sign posted to warn of a dangerous dog at all entrances.
A dangerous dog is a dog that substantially punctures skin by teeth without causing serious injuries or aggressively attacks in a way that presents an imminent threat of serious injuries. A dog that kills a pet animal while off its owner’s property can also be classified as dangerous. Vicious dogs are those that inflict a serious injury on someone or inflict a serious injury when someone is trying to avoid the attack. Exemptions apply to police and military dogs, or situations in which the victim was trespassing or abusing the dog.

Prior Aggression
