Geico logo

It happens all of the time in this industry. An individual is injured in a car accident, and he or she turns to the auto insurer – a company that the individual has been with for years, loyally paid the premiums to, and one that the customer assumed would be there when the time came to file a claim. Geico originally started in 1936, and since then, the company has exploded into one of the nation’s largest auto insurers. They are known for offering their customers the best rates and coverage options. Today, they are headquartered in Chevy Chase, Maryland, where they still offer insurance policies for all types of vehicles.

Intervenes on a Geico Claim Denial

Earlier this year, a client of Van Sant Law, LLC came to us because Geico was denying coverage for an automobile accident. The customer of Geico suffered from bodily injury and turned to the insurance provider for coverage of the claim.

Pokémon Go distraction Van Sant Law

Pokémon Go is a great way to get up and get out to interact with the world. It has taken adults, teens, and even children, and turned them into Pokémon-catching junkies. While there’s nothing wrong with enjoying an app and having a little fun, there is something wrong with doing so while operating a motor vehicle.

One would assume that people know better than to drive and use their phones – after all, it is illegal. But, there is a shocking number of people who are using their Pokémon Go app while driving, despite the laws. It is not just happening in the United States, either. Countries like the United Kingdom and New Zealand have seen their fair share of accidents caused by using this app, according to The Atlantic. The app has already released in 38 other countries and government officials have a right to be concerned.

Use of the app has also forced people to wander into hazardous situations, such as entering caves, walking in front of vehicles, and even entering a stranger’s backyard. The mapping feature on the app is leading people into areas where they shouldn’t go, including restricted areas.

slip and fall wet floor warning sign Van Sant Law

In order to prove that your slip and fall claim is legitimate, you must first be able to show that the responsible party (the defendant) was aware or would have been aware of the danger that existed, and did nothing to prevent your injury from happening. Premise liability is defined as a landlord’s tort liability for conditions or activities that occur on the premises. Premise liability claims, including slip and fall cases, occur when a plaintiff is injured on the property of the defendant – this can be a private property or business property. Proving these cases is exceptionally difficult, and will require the assistance of an Atlanta personal injury attorney.

The Property Owner’s Duty and Negligence

Premise liability actions require multiple things. First, the owner owes a duty to provide you with a safe visit to the property, but you must establish first that you had a right on that property. For example, if you were visiting a business and were injured on the property, or you were invited by the property owner, then you have a right to be there. If you do not have a right to be on the property and you are injured while trespassing, you cannot find a claim against the owner – regardless of the condition or cause that injured you.

hire personal injury attorney Van Sant LawThere are dozens of attorneys in the Atlanta area who are qualified to assist an injured person in pursuing a personal injury claim. While a large majority of such claims are filed for car accident injuries, there are other reasons why one may seek the services of a personal injury attorney – slip and fall accidents, nursing home abuse/neglect, etc. There are some attorneys who specialize only in certain aspects of personal injury law (such as handling only car accidents), while other attorneys branch out and offer a broad range of services for injured parties.

When you perform an Internet search, you may notice that there is a plethora of personal injury attorneys out there. You may also notice billboards, newspaper advertisements, radio advertisements, and even television commercials where attorneys offer their services to those who have been injured and need legal help. When you are looking for an attorney yourself, you may quickly become overwhelmed by the choices. Luckily, there are things that you can do to narrow down the choices, while ensuring that you are picking an attorney who is best-suited for your case.
