Atlanta Medical Malpractice Attorneys Serving All of Georgia
Medical malpractice is a disturbing topic of conversation. It would be downright terrifying if more people knew about the admission offered by the American Medical Association itself – that it is the nation’s third-leading cause of death. What’s frustrating is that it may be difficult to even be sure that your malady was caused by malpractice.
In our experience, most doctors are worth their weight in gold — most incidents of malpractice come from the same few doctors, over and over again. Even a good doctor, however, can suffer a lapse in judgment that adds up to professional misconduct. When that happens, you are entitled to full compensation, and we know the most effective ways of seeking it.
“I Can’t Afford to Hire a Law Firm”
Believe it or not, if you have a strong claim, you can afford to hire us even if your wallet is empty. Our “batting average” of victory is so high that we can afford to work on a contingency basis – in other words, you will owe us nothing in legal fees if we fail to secure compensation for you. That doesn’t mean we will give you a refund – it means we will never bill you in the first place.
Our Winning Record
At Van Sant Law, LLC, we win well over 90% of our cases. Founding partner David Van Sant has worked as an insurance company defense lawyer, which means he has seen it all from the other side of the table. He possesses intimate knowledge of the strategies used by insurance companies to deny claims.
Mr. Van Sant, like the majority of our attorneys, has been named a Georgia Super Lawyer, an honor accorded to only 2.5 percent of the state’s lawyers. He has also been named one of the Top 100 Trial Lawyers in Georgia by The National Trial Lawyers. He is a lifetime member of the Multi-Million Dollar Advocates Forum because of the size of the compensation he has won for his clients.
One of Our Clients Speaks Out
“Van Sant Law was great at handling my case from beginning to end. My case manager and attorney Jay Drew always returned my calls and emails asap even though I was a little annoying most of the time. 🙂 My case was settled fast and easy!” – Elvis Cudd
What type of damages are available under Georgia personal injury law?
The state allows three different types of damages, depending on the facts of the case:
- Economic damages: Medical bills, lost work time and just about any loss you can easily count.
- Noneconomic damages: Intangible damages such as mental anguish and loss of enjoyment of life.
- Punitive damages: An additional amount awarded to punish the defendant for particularly outrageous conduct (most cases do not qualify for punitive damages, however).
I heard that Georgia has placed a cap on non-economic damages in medical malpractice cases. Is that true?
No, not anymore. A few years ago, the state capped noneconomic damages in medical malpractice cases, but the Georgia Supreme Court declared the law unconstitutional (based on the state constitution).
How often are medical malpractice claims settled out of court?
Almost all of the time. According to the U.S. Bureau of Justice, 93 percent of all medical malpractice claims are resolved through private settlement. Health care providers don’t like to go to court, because they consider juries unpredictable and because they don’t want to publicize claims against them.
