Can I Still Recover Damages if the Accident Was Partly My Fault?

Sometimes. Under Georgia’s comparative fault principle:

  • If you were less at fault than the defendant was, your damages will be discounted by your percent of the fault.
  • If your fault was equal to or greater than the defendant’s fault, you will not receive any damages.
  • If your fault was greater than the defendant’s fault, you might have to pay him damages
Can I Sue the Manufacturer of a Defective Auto Part, Such as a Brake Drum or an Airbag?

Yes. You can win a product liability claim if you can prove that the product was defective and unreasonably dangerous. Georgia applies a 10-year statute of repose that limits product liability to accidents that occur within 10 years after the product first entered the stream of commerce.

Are Punitive Damages Possible?

Yes, they are possible, although Georgia courts are reluctant to award them and most claimants do not receive them. To qualify for punitive damages in Georgia, you must prove that the defendant acted with willful misconduct, malice, fraud, wantonness, oppression or an utter disregard for your safety.
