Experienced Personal Injury Lawyers Assisting Car Accident Victims in the Marietta, Georgia Area
Marietta, Georgia is much more than just a suburb of Atlanta. One indicator of what Marietta is like to experience is its 2011 CNN Money designation as one of the top 25 places in the U.S. to retire. Attractions like the Strand Theatre and the Marietta Gone with the Wind Museum are examples of what kind of adventures await those with the initiative to explore the city.
Traffic on the North and South Marietta Parkway can get intense, as can the I-75 traffic leading to and from Atlanta. Car accidents can be particularly catastrophic on high-speed highways like these. These risks might be on the back of your mind every time you travel by car. An injury accident, however, will immediately jolt them to the front of your mind in most distressing fashion.
You Owe It to Yourself to Seek Justice
A serious accident in indignity enough. When you realize that your pain was all caused by someone else’s misconduct, indignity typically matures into anger – and rightfully so. You have been wronged, and you owe it to yourself to right that wrong. Georgia personal injury law can help you do so by giving you a legal claim for compensation.
Claims do not enforce themselves, however – normally it takes a skilled and experienced personal injury lawyer to do that, at least if you insist on receiving your claims’ full value. At Van Sant Law, we convert car accident claims into cash for well over 90 percent of our clients. We invite you to put us to work so that you can focus on recovering from your injury.

Frequently Asked Questions (FAQs)
Can I still recover damages if the accident was partly my fault?
Sometimes. Under Georgia’s comparative fault principle:
- If you were less at fault than the defendant was, your damages will be discounted by your percent of the fault.
- If your fault was equal to or greater than the defendant’s fault, you will not receive any damages.
- If your fault was greater than the defendant’s fault, you might have to pay him damages
Can I sue the manufacturer of a defective auto part, such as a brake drum or an airbag?
Yes. You can win a product liability claim if you can prove that the product was defective and unreasonably dangerous. Georgia applies a 10-year statute of repose that limits product liability to accidents that occur within 10 years after the product first entered the stream of commerce.
Are punitive damages possible?
Yes, they are possible, although Georgia courts are reluctant to award them and most claimants do not receive them. To qualify for punitive damages in Georgia, you must prove that the defendant acted with willful misconduct, malice, fraud, wantonness, oppression or an utter disregard for your safety.
Punitive damages awards can be quite large.
In general, what must I prove to win a negligence personal injury claim?
You must prove:
- The defendant breached a duty of care he owed to you (by driving recklessly, for example);
- The defendant’s breach of duty actually caused the accident; and
- You were injured in the accident and thereby suffered damages.
