Accident and Injury Lawyers Serving the Injured in the Gainsville, Georgia Area

Gainesville, Georgia, the Poultry Capital of the World, has a lot more than poultry to offer. Its convenient location, only about an hour’s drive from Atlanta, brings us here to enjoy Lake Lanier and the relaxing scenery of the Blue Ridge Mountains. Boating on Lake Lanier is a particularly favorite pastime for several of us.

The charm of Lake Lanier is alluring. Unfortunately, it masks a darker reality that most of us would rather not think about – any one of us could fall victim to a serious personal injury at just about any moment. No matter how careful we are, disaster can strike simply because of the wrongful behavior of someone else. The injustice of that scenario is what Georgia personal injury law is designed to correct.

You Don’t Have to Take It Lying Down

A serious personal injury may have knocked you off your feet – physically, emotionally and financially. Murphy’s Law seems to be operating when medical expenses roll in and lost work time accumulates, all at the exact moment when you are too busy dealing with the trauma of your injury to even begin to handle the financial demands that are being made on you.

Let us handle it. At Van Sant Law, LLC, making you whole is our profession – at least as far as financial compensation is capable of accomplishing that goal. And we are good at what we do, as recognized by both our peers and our clients:

  • Three of our firm’s five lawyers have been named Georgia Super Lawyers, an honor awarded to less than three percent of Georgia lawyers.
  • Our founding partner, David Van Sant, was named one of Georgia’s Top 100 Trial Lawyers by The National Trial Lawyers, and has won the Avvo Client’s Choice Award several times.
  • Our firm maintains an A+ rating with the Better Business Bureau.

Our Main Practice Areas

We handle personal injury claims in many different areas:

Frequently Asked Questions (FAQs)

How can I pay my medical bills before my settlement or verdict arrives?

You have three main options:

  • Med-Pay (no-fault supplemental auto insurance), if you have it.
  • Your own health insurance. You must exhaust any Med-Pay benefits first.
  • If you don’t have Med-Pay or health insurance, we can help you negotiate a payment deferral with your healthcare provider.

How long do I have to file a personal injury lawsuit over a car accident?

In most cases, you have two years from the date of the accident to file a lawsuit. If you miss the deadline, even settlement negotiations will be fruitless, since the defendant will have no incentive to negotiate with you. There are limited exceptions to this two-year deadline.

How can I prove a negligence personal injury claim?

You must prove four elements to win:

  • The defendant owed you a duty of care (to drive safely, for example)
  • The defendant breached his duty of care (duty plus breach equals negligence).
  • The defendant’s negligence was a substantial cause of the accident.
  • Your injuries were caused by the accident.

You will also have to prove the amount of damages your injuries cost you.

What are future damages?

If your injuries necessitate long-term medical care, you might still be incurring medical bills long into the future. You might also still be suffering lost earnings and other losses. Future damages are an estimate of these expenses that must be included in any damages claim.

Make It Happen by Taking Decisive Action Today

Eloquent words and brilliant reasoning will only take you so far. The bottom line is how much a lawyer can actually recover for his client. Founding partner Mr. Van Sant is a lifetime member of the Multi-Million Dollar Advocates Forum (only one percent of lawyers qualify), due to the size of the recoveries he has won for his clients, and our other lawyers have won compensation packages of similar size.

Although we are legally prohibited from guaranteeing the size of your recovery, we can guarantee that you will owe us nothing in legal fees unless we bring home compensation for you. This eventuality is unlikely only because we win well over 90 percent of our cases.
