Under O.C.G.A. Section 51-2-7, someone who owns or keeps a dangerous or vicious animal and who, by careless management or by permitting the animal to go at liberty, inflicts an injury on someone else can be held accountable for damages. To prove a vicious propensity, it is enough to show that the attacking animal was required by an ordinance to be restrained, but the animal was not restrained at the time of the attack. You will also need to show that the owner of the pet had superior knowledge of the pet’s aggressive tendencies. However, a plaintiff in an animal attack case cannot recover damages if they were trespassing or if they provoked the injury through their own acts toward the animal.

Under Georgia law, moreover, any pet owner who owns an animal that is known to be aggressive may be held liable when that animal attacks and injures someone.

Wild or Non-Domesticated Pets

Dogs are the animals most commonly responsible for attacks. Under Section 4-8-21, dogs may be classified as dangerous or vicious. For example, the owner of a dangerous dog needs to keep a locked and secure enclosure to restrain the dog on the owner’s property. There must be a clearly visible sign posted to warn of a dangerous dog at all entrances.

A dangerous dog is a dog that substantially punctures skin by teeth without causing serious injuries or aggressively attacks in a way that presents an imminent threat of serious injuries. A dog that kills a pet animal while off its owner’s property can also be classified as dangerous. Vicious dogs are those that inflict a serious injury on someone or inflict a serious injury when someone is trying to avoid the attack. Exemptions apply to police and military dogs, or situations in which the victim was trespassing or abusing the dog.

Prior Aggression

An Atlanta animal attack attorney also can help you hold an animal owner accountable if the animal was aggressive prior to attacking you in such a way that the owner should have known that it had a propensity to attack. The aggression must be something more than barking or baring teeth. It may be difficult to prove that a dog that bit you was aggressive, especially if the attack occurred in a Georgia county that does not have a leash ordinance.
