This week has been National Playground Safety Week, so as we head into the weekend, we think it’s appropriate to share some information about playground safety. The National Program for Playground Safety(NPPS) sponsors efforts to reduce the number of playground injuries. It’s a great idea, because more than 200,000 kids are seen in emergency rooms every year for playground injuries.

While many of the recommendations made by the NPPS are aimed at municipalities and school districts, individual property owners can find themselves responsible for play equipment injuries that occur on their properties. Here are some tips to help protect children as they use outdoor play equipment:

The Georgia State Fair is opening today in Macon, If you’re looking for something interesting and fun to do, try to get out there between now and May 7 to take advantage of all the exhibits, rides, music, entertainment and activities. Here are a few tips for having the best time possible at the Georgia State Fair:

If you’ll be taking your children to the fair, you may want to take a few minutes before you arrive to explain to them the importance of sticking together. A buddy system is particularly helpful in crowds. Pair adults with the smallest children, and put older kids together in pairs to help ensure that everyone has a buddy and knows they are responsible for staying together. Also discuss what to do in the unlikely event they get lost.

When you arrive at the fair, be sure you lock any valuables that have been brought along on the trip up in your trunk. Be sure to lock your car and stow away visible items like GPS navigation systems, electronics, or purses.

The New York Times is following a story that involves liability issues in a fatal car crash that was caused by a driver who was using a car from a “car sharing” service known as RelayRides.

RelayRides is one of dozens of businesses that are popping up to help out in this economy. The business serves as an online matching service that allows individuals to rent their cars by the hour to other people who need one. Most renters have lost their cars to the bank or simply can’t afford to own one due to high gas or insurance costs. The concept is to make transportation available to everyone, but when you put cars on the road, there is liability involved.

According to the 2011 Georgia Crash Analysis Statistics and Information Report (CASI), one quarter of all roadway fatalities in the state are alcohol related. The fight against drunk drivers does not rest solely in the hands of the authorities, though. Reporting a suspected impaired driver is considered an emergency and is classified as an appropriate use of 911 services.

In Georgia, the CASI reported that the most likely vehicle for an impaired driver to operate is a truck. Perhaps the most common behavioral red flag in identifying an impaired driver is raised when a vehicle weaves back and forth across the road way, but there are many other indicators that could signify an impaired driver.

There are many situations that we deal with as personal injury attorneys in Georgia, and oftentimes the outcome of a situation is difficult to predict. However, in this economy, there are several precedents emerging for the victims of accidents who later file for bankruptcy that may involve losing the proceeds from a personal injury claim.

If you have been the victim of an accident and you are faced with personal bankruptcy, the strongly advises caution in your proceedings. The laws vary from state to state, and the findings in bankruptcy court will vary from case to case, but, if you file for bankruptcy because you are unable to work as a the result of an injury, the bankruptcy court may rule that the settlement you receive should be divided first among your creditors.

I recently spoke with a client who had been injured when a utility trailer being towed by a large, luxury RV came loose on a highway and smashed into his vehicle. After a little research, I found an interesting website that documents these sorts of accidents, which it turns out, are quite common.

The website, called Dangerous Trailers, allows you to search by state, where you will find documentation on 100 accidents in the state of Georgia that were caused by utility trailers. According to the website’s owner, there are close to 3,000 accidents that have been written about in Georgia newspapers that involved utility trailers .If you look nationwide, there are more than 500,000 people who have been injured by runaway trailers since 1988.

These trailers are used by commercial businesses of all sorts (from carpet layers to construction companies). They are used for recreational purposes to carry motorcycles or ATVs, and they are used often behind motorhomes and luxury buses to transport items like bicycles, gas grills, porch swings, or other “camping gear.”

Students and families around Georgia are making their spring break plans. For many, this means jumping in the car with the family and heading off to the beach, the ski resort, or a campground. Starting in mid-March, Georgia highways will be full of families like that, as well as college students heading in and out and through Atlanta, Savannah, Myrtle Beach, Florida…we’re in the middle of a big traffic flow year round, but spring break can bring more traffic through Georgia than other times of the year.

Vacation time can also be stressful time, especially if you are traveling a great distance, carrying a large group, or spending a lot of money. The last thing you need is a car accident.

As an Atlanta car accident lawyer, I typically see a rise in my caseload this time of year. Sadly, many families that head out for a fun vacation end up with anything but. Smart travelers know that they have to be overly cautious during heavy travel periods. But accidents do happen.

When it comes to avoiding accidents, much depends on the roads themselves. Winters can be rough on Georgia roads and highways, and that can be tough on your car or truck. Just as the ground hog comes out in early February to determine how much longer the winter will be, pot holes seem to come out in March, followed closely by the road crews.

Road work also can mean traffic snarls, and while every driver wonders at one time or another why the road crews chose “right now” to fix the particular road they are on, the reason is probably, “It’s been on the list for a while, and today is the day.”

I was driving to work yesterday and became a little aggravated at the person in front of me. I’ve written before in this blog about distracted drivers. Yesterday, the woman in front of me kept tapping her breaks at the oddest times. We were moving along at a pretty steady clip, and then “tap,” her break lights would come on. After this happened a couple times, I decided it was time to pass this lady before she caused a car accident.

As I passed by her on the left, I looked over, and dare I say I was not surprised to see that she was texting. I made a few glances as I passed, and from what I could tell, she was not watching the road at all. That certainly explained her constant “brake tapping,” but when are drivers going to learn you cannot text and drive at the same time?

In my line of work I’ve seen the disaster that texting while driving can cause. I know of teenagers who never made it home from school one day because they were texting while driving. I know of children who are without their mother because a distracted texter slammed her car into a bridge. I know how painful it is for a father to realize that his daughter will not be graduating because she texted herself into an early grave.
