Earlier this month, we announced a $1.3 million settlement that our firm, Van Sant Law, LLC, secured for an auto accident victim. We are now providing additional details on that settlement and the accident that led up to it. Our client, who was a 67-year-old retired man, who had been severely injured in a T-bone collision on January 10, 2013. The accident occurred after the other driver’s vehicle struck the side of our client’s truck on Highway 53 in Dawson County, Georgia, which knocked the truck off the road. Following the accident, the other driver received a traffic citation for failing to stop at a stop sign.
As a result of the truck accident, our client suffered from a punctured lung, a punctured spleen and a bruised heart. He also suffered from fractures to the sternum, clavicle, ribs, tibia, ankle and toes. This led to the accident victim having to stay in the intensive care unit (ICU) from January 10-14. He was not able to undergo surgery on his leg and ankle until January 15 because the bruising on his heart was so severe. The man was hospitalized until January 23, after which he returned home via medical transport.
The end of our client’s hospitalization was by no means the end of his medical challenges. At home, he had to depend on a wheelchair, a medical bed and in-home health care. After several months of trying to recover at home, it was discovered that the man’s other leg was also fractured because of his accident. After being treated for that, he had to deal with having a hard cast on his left leg because of his previous surgery and a short pneumatic boot on his right leg because of his recently discovered injury.
An onslaught of infections on our client’s left ankle (the area where the surgery was performed) complicated his recovery. Because of these infections, he had to have the hardware on his leg removed, and he had to be closely monitored by an infectious disease doctor. He was ordered to receive IV antibiotics on a daily basis, and he also had to use a wound vacuum.
At the time of this accident victim’s settlement, he had incurred roughly $418,000 in expenses, but he was still confined to a wheelchair and still battling leg infections. In order to effectively demonstrate the true magnitude of our clients’ everyday struggles and the lifelong care that he would require in the future, our firm worked with a life care planner and a video production crew. In the end, we were able to obtain a settlement for the policy limits of $1.3 million. The settlement was reached on November 14, 2013. The case had been filed in the Superior Court of Dawson County in Georgia.
